1. Introduction
Elite AI HVAC is a brand operated by AI RenoSystems Inc. These Terms of Service ("Terms") govern the use of the services provided by Elite AI HVAC ("we," "us," or "our"). By engaging our services, you ("Client") agree to be bound by these Terms. If you do not agree with these Terms, you may not use our services.
2. Services Provided
Elite AI HVAC offers AI-based automation services for HVAC and home services businesses, which may include but are not limited to: - AI receptionist (automated phone answering and appointment scheduling) - AI marketing tools and services - AI-powered outbound calling systems - Automated email and SMS management - AI-driven sales call analysis - Customer reactivation and lead follow-up systems - Custom automation solutions tailored to Client needs. Services are customized per client based on their unique operational and marketing requirements.
3. Pricing and Payments
All pricing is determined on a client-by-client basis and will be defined in a separate written agreement. No refunds shall be issued once services have commenced, unless otherwise agreed in writing between the Client and Elite AI HVAC.
4. Client Responsibilities
Clients are responsible for providing accurate information necessary for service implementation, including but not limited to: - Calendar access and configurations - CRM platform integration details - Call system access and routing information. Clients must ensure they have the legal right to provide such access and shall remain responsible for all activities occurring under their systems.
5. Third-Party Services and Integrations
Our services may integrate with third-party tools and platforms at the request of the Client. We are not liable for issues, interruptions, data loss, or breaches caused by such third-party services. It is the Client's responsibility to ensure compatibility and compliance of third-party platforms with their internal policies and laws.
6. Acceptable Use
Clients agree not to use our services for any unlawful, harmful, abusive, or deceptive practices, including but not limited to: - Spamming or mass unsolicited messaging - Misrepresentation of identity or service - Collection of information without consent - Activities that violate applicable laws. Elite AI HVAC reserves the right to suspend or terminate services immediately upon discovering such use.
7. Intellectual Property
All proprietary tools, methods, scripts, and software created by Elite AI HVAC remain our intellectual property unless expressly transferred in writing. Clients receive a limited, non-transferable license to use our solutions solely for their internal business operations.
8. Limitation of Liability
To the fullest extent permitted by law, Elite AI HVAC shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of revenue, data, or business interruption. Liability for any claim shall not exceed the amount paid by the Client in the 30 days preceding the event giving rise to the claim.
9. Termination
Either party may terminate the service agreement with written notice, subject to any contractual obligations. Upon termination, all outstanding fees shall become due and any licensed use of our tools shall cease unless otherwise agreed.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
11. Amendments
We reserve the right to amend these Terms at any time. Clients will be notified of material changes, and continued use of services after such
notification constitutes acceptance of the revised Terms.
